Overview of the rights you have if you are supporting a friend or relative (unpaid carer)
Unpaid carers play a vital role in supporting family members, friends or neighbours who cannot manage without help. Below is an overview of some of the rights you may have that protect your wellbeing, independence and ability to care.
You have the freedom to decide whether or not to take on a caring role. This includes choosing how much support you are willing and able to provide.
Your views must be considered when care plans are being made for the person you support. Social services should involve you in decisions that affect your caring role.
You are entitled to a free assessment from Hampshire County Council to explore how caring affects your life and what support you may need.
If you’re employed, you can request changes to your working hours or pattern to help balance work and care. This applies from your first day in a job.
Under the Carer’s Leave Act 2023, you are entitled to up to five days of unpaid leave per year to provide or arrange care.
You have the right to pursue employment, education, training and leisure activities alongside your caring role. Support should be available to help you maintain your independence.
You are protected from discrimination under the Equality Act 2010 and broader human rights legislation, due to your association with a disabled person. This includes protection in the workplace, access to services, and public life.
These organisations can help you understand and exercise your rights:
