This privacy notice tells you about how the Council collects and uses personal information held in the Planning Policy Consultation Database.
Hart District Council is the data controller and data processor for the personal data you have provided for this purpose.
Where personal details are held for the purposes of consulting statutory consultees, the lawful basis for processing of this information is ‘public task’ as defined under Article 6(1)(e) of the UK General Data Protection Regulations. Local plan-making has a clear basis in law primarily the Planning and Compulsory Purchase Act 2004 and the Levelling Up and Regeneration Act 2023.
Where personal details are held at the request of individuals or organisations choosing to be notified of consultations and updates, the lawful basis is ‘consent’.
We will use your personal information to contact you when undertaking local plan and other planning policy-related consultations and updates.
Personal data received via consultation responses will be covered by a separate privacy notice.
We will not share your data with any outside parties. The data held is administered only by Hart District Council staff.
We will not share your personal data except if required to do so by law. We take the security of your personal data seriously. We have internal policies and controls in place to ensure that your personal data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties.
Your personal data, if held on a ‘consent’ basis, will be held until such time as you indicate that you no longer wish to be on the database. You can do this by contacting planningpolicy@hart.gov.uk
Personal data held on a ‘public task’ basis will be held until it is found to become out of date.
