Planning Appeals
An appeal can be made to the Secretary of State, where planning permission has been refused, an application was granted with conditions considered inappropriate, or an application was not determined within the appropriate time. In Enforcement matters appeals can be submitted where an Enforcement Notice has been served due to an alleged breach of planning control.
If you are considering appealing on a refusal or conditions of a planning application you should first speak to your case officer to discuss whether you can amend the proposal to make it acceptable to the Council. However, if you have decided to proceed with making an appeal this should be submitted to The Planning Inspectorate, an executive agency in the Department for Communities and Local Government. In the majority of cases the appeal will be decided by a Planning Inspector, appointed by the Secretary of State.
There are a number of methods of submitting your appeal, this can be done online via the Planning Portal, or by contacting The Planning Inspectorate’s Customer Services Team to request the appropriate forms.
When an appeal is lodged, the Council will notify all those originally informed of the planning application and those who made representations, to enable you to make any further comments to The Planning Inspectorate, where the appeal procedure permits. Details of appeals made, and all associated documents can be viewed online under the Council’s reference number of the planning application using Planning Online or via the Planning Portal, using the Planning Inspectorate's appeal reference number.
